The Town of Edisto Beach’s Municipal Court is an independent branch of Town government appointed by Town Council, and funded through the Town. It is one of about 200 municipal courts across South Carolina, and was established in 1986, the same year Town Hall and the Fire Station was built. The court’s geographic jurisdiction encompasses all of the Town limits in Edisto Beach. Its subject matter jurisdiction is over cases arising under ordinances of the municipality, and over all offenses which are subject to a fine not exceeding $500.00 or imprisonment not exceeding 30 days, or both, and which occur within the municipality. There are also specific state statutes which grant municipal courts jurisdiction over other cases involving specific crimes for which the punishment can be up to one year imprisonment or a fine of $5,000, or both, upon petition by the solicitor and agreement by the defendant. The court has the power to conduct bench and jury trials, issue search and arrest warrants, may set bail, can conduct preliminary hearings, and cite persons for contempt of court. However, Municipal court has no civil jurisdiction.
